No triable issue is presented. Notice of dishonor of the note in suit was waived. (Neg. Inst. Law, § 180; Nat. Hudson River Bank v. Reynolds, 57 Hun, 307; Sheldon v. Horton, 43 N. Y. 93; Cady v. Bradshaw, 116 id. 188.) This issue was presented in the Municipal Court and determined adversely to the defendant by the judgment therein. Order reversed, with twenty dollars costs and disbursements, and motion granted. Present — Finch, P. J., Merrell, Townley, Glennon and Untermyer, JJ.
