Opinion

ON atrial in the Circuit Court of an action of assumpsit •commenced before a justice of the peace, receipts.and orders of the plaintiff for money, tending to prove payment of the demand, are admissible evidence for the defendant,though no plea have been filed; the evidence being admissible under the general issue, and the defendant in such case being entitled to the benefit of that plea, by statute, without pleading it.
