This case turns upon the same question decided in No. 250, Twin City National Bank v. Nebeker (ante, p. 190), and was argued and submitted therewith.

In accordance with the opinion therein, the jtidgment herein appealed from must be affirmed, with costs to the appellee ; and it is so ordered.
