15 This matter came before the Honorable Benjamin C. Sison, Jr. on Steven Eustaquio 16 Shimizu's ("Defendant") Motion to Modify Child Support. Attorney Joaquin C. Arriola, Jr. 17 Esq. appeared on behalf of the Defendant and attorney Gloria Lujan Rudolph, Esq. appeared 18 on behalf of the Plaintiff Letitia S. Lujan ("Plaintiff'). Having reviewed the evidence and 19 the arguments presented, the Court issues the following Decision and Order DENYING the 20 Defendant's motion to modify child support. 21

22 BACKGROUND AND PROCEDURAL HISTORY 23

24 Letitia Lujan ("Plaintiff') and Steven Shimizu ("Defendant") divorced in May 25 2014. The marriage produced four children. An Integrated Marital and Property Settlement 26 Agreement was entered into by the parties and filed with the Court on May 22, 2014. 27 Pursuant to this agreement, the parties agreed to joint physical and legal custody of the four 28

2 time." ld. at

3 Agreement into the Interlocutory Decree of Divorce.

4 On July 28, 2015, Plaintiff filed an Ex Parte Motion for Order to Show Cause,

5 requesting restraining orders and a modification of custody. This Motion was filed pursuant

6 to Plaintiffs allegations that Defendant had acted inappropriately, including physical

7 aggression toward the children, instructing one of the minor children to make unfounded

8 allegations against the Plaintiffs boyfriend, emotionally abusing the children, and

9 harassing the plaintiff. Defendant denied all of the allegations during a hearing which

10 began on July 29, 2015, and ended October 14, 2015. An Order after Hearing was issued

11 the Honorable Arthur R. Sarcinas on October 15, 2015, granting Plaintiff a restraining

12 order against Defendant. A status hearing was held on April 13, 2016 and Judge Barcinas

13 ordered the parties to cooperate with one another and to insulate the children from any

14 friction between the parties. Both parties ultimately retained joint equal physical custody of

15 their children.

16 On June 1, 2016, approximately 2 years after their divorce, Defendant filed a

17 Motion to Modify Child Support, wherein he petitioned the Child Support Hearing Officer

18 for a modification of support orders, alleging a "substantial or material change of

19 circumstances" as a result of the eldest child having reached the age of majority and

20 because Plaintiff's income allegedly has significantly and substantially increased. Plaintiff

21 filed her Opposition to Defendant's Motion on June 22, 2016. The case was assigned to

22 the Child Support Referee Linda Ingles for disposition.

23 On October 18, 2016, Defendant filed a Subpoena Duces Tecum, requesting all of

24 Plaintiff's paystubs, paychecks, tax returns, bank statements, employment agreements, or

25 any other income documentation from 2013 to the present. Plaintiff objected to this

26 subpoena on October 19, 2016. In response, on December 14, 2016, Plaintiff filed an Ex

27 Parte Motion for Protective Order, Motion to Quash Subpoena Duces Tecum, and For

DM0308-14, Lujan v. Shimizu Page 2 of 10 Decision and Order Re: Def' s Mot. for Modification of Child Support 1 Attorney's Fees and Costs. Plaintiff concurrently filed a Motion to Enforce Settlement

2 Agreement, Impose Sanctions, and A ward Fees and Costs.

3 On April4, 2017, Plaintiff filed an Ex Parte Application for Order to Show Cause

4 and Motion to Enforce Decree, arguing that Defendant should be held in contempt of

5 Court. Plaintiff alleged that Defendant had continued to violate the Court's "Order After

6 Hearing" dated April21, 2016 and the Decree of Divorce by: 1) unreasonably withholding

7 consent for Plaintiff to travel off-island with the children, 2) continuing to disparage

8 Plaintiff and her husband, and 3) unlawfully interfering with Plaintiff's custody of her child

9 on January 13, 2017. This motion was withdrawn by Plaintiff the next day, April 5, 2017.

10 Plaintiff filed another Motion for Order to Show Cause on June 6, 2017. Plaintiff

11 alleged that Defendant had failed to fully comply with the Subpoena Duces Tecum filed

12 August 8, 2016, despite Defendant's failure to file an objection or motion to quash.

13 On June 7, 2017, Plaintiff filed her Brief Re: Material Change of Circumstances;

14 Credit for Health Insurance Not Paid by Parent. This brief relates to Defendant's June 1,

15 2016 Motion to Modify Child Support, and was filed with the purpose of refuting

16 Defendant's argument that a material change of circumstances had occurred.

17 On June 16, 2017, a non-party subpoena recipient, Guam Windward Memorial,

18 filed an Objection to an Amended Subpoena Duces Tecum. On June 26, 2017, non-party

19 subpoena recipient, Joseph Shimizu, also filed an Objection to an Amended Subpoena

20 Duces Tecum.

21 On June 30, 2017, Plaintiff filed a Request for Reassignment of the case to another

22 judge, arguing that Child Support Referee Linda Ingles faced potential conflicts concerning

23 a witness regarding Defendant's Motion to Modify Child Support.

24 On July 10, 2017, Plaintiff filed a Motion for Contempt against non-party Ambros,

25 Inc., claiming Ambros had failed to produce documents subject to a Subpoena Duces

26 Tecum. Ambros filed its Objection to Amended Subpeona Duces Tecum on August 7,

27 2017.

Shimizu Page 3 of 10 Decision and Order Re: Def' s Mot. for Modification of Child Support 1 Defendant filed an Ex Parte Motion for Order to Show Cause, Motion for 2 Contempt; Wage Assignment Order; Child Support Arrears on September 7, 2017. 3 Defendant argues that Plaintiff should be held in contempt for failure to pay $1,000 per 4 month in temporary child support as ordered by Child Support Hearing Officer Linda 5 Ingles on June 7, 2017. Plaintiff filed her Opposition on October 5, 2017. 6 A hearing was scheduled before Magistrate Benjamin C. Sison Jr. on Defendant's 7 Motion to modify on October 5, 2017. Because of pending discovery issues, the court set a 8 continued hearing for November 9, 2017 which was then continued to November 16, 2017.

9 On November 9, 2017, Defendant served Plaintiff with a Subpoena Duces Tecum, 10 requesting paystubs, W2 forms, and bank statements. On November 14,2017, Plaintiff

11 filed an objection. 12 On November 15, 2017, Plaintiff filed an Ex Parte Motion for Protective Order,

13 Motion to Quash Subpoena Duces Tecum and for Attorney's Fees and Costs. Defendant 14 filed an opposition on November 16, 2017.

15 At the continued hearing on November 16,2017 the parties were ordered to cease

16 further discovery and submit briefs answering the question as to whether there is a legal

17 basis to support a modification of the child support provisions in this matter. On December

18 14, 2017, both parties filed briefs with the Court. The Court took the matter under
