After Remand from the Alabama Supreme Court

McMILLAN, Judge.

Based on the Alabama Supreme Court’s decision in Ex parte Lucas, 792 So.2d 1169 (Ala.2000), and the caselaw relating to civil cases cited therein, we remand the case to the trial court for that court to enter a judgment of acquittal.

REVERSED AND REMANDED.
