Patent. On defendant’s motion to dismiss plaintiff’s petition, or in the alternative to grant summary judgment for the defendant, it was ordered that defendant’s motion be granted, and plaintiff’s petition be dismissed on the grounds that said petition, together with the more definite statement of said petition, filed February 6,1958, fails to state a cause of action within the jurisdiction of this court.
