Opinion

MADDOX, Justice.

This Court granted certiorari review to consider the Court of Civil Appeals’ holding that denied the employer a setoff against the employee’s workers’ compensation benefits. That portion of the Court of Civil Appeals’ judgment denying the setoff is reversed and the cause is remanded. See Ex Parte Dunlop Tire Corp., 706 So.2d 729 (Ala.1997).

REVERSED AND REMANDED.
