AFTER REMAND FROM SUPREME COURT

HOLMES, Presiding Judge.

The prior judgment of this court which reversed and remanded the case has been affirmed in part and reversed in part by the Supreme Court of Alabama. On remand to this court, and in compliance with [1109]*1109the supreme court’s opinion of January 13, 1989, 541 So.2d 1104, this cause is reversed and remanded for proceedings not inconsistent with the supreme court’s opinion.

REVERSED AND REMANDED.
