Opinion
Judgment and order reversed upon the law and the facts and a new trial granted, costs to abide the event. We are of opinion that there should be a new trial of this cause in the interests of justice. Lazansky, P. J., Kapper and Tompkins, JJ., concur; Hagarty and Seudder, JJ., dissent and vote to affirm.
