We agree with the learned judge at Special Term in concluding that the demurrers to the complaint are controlled by the case of Randall v. Van Wagenen, 115 N. Y. 527, 22 N. E. 361, 12 Am. St. Rep. 828: We think, therefore, that the judgment should be affirmed, with costs.
