Opinion

OPINION OF THE COURT

Memorandum.

Judgment affirmed, without costs.

In our opinion, the lower court correctly determined that the record was devoid of any evidence of culpable conduct on the part of plaintiff Norbert Leiner. We pass on no other issues raised in the lower court’s opinion.

Jones and Kunzeman, JJ., concur. Buschmann, J. P., taking no part.
