Memorandum by the Court.

The petition fails to disclose any factual or legal basis for petitioner’s assumption that the respondents are “about to proceed without or in excess of jurisdiction”. (CPLR 7803, subd. 2.) We reach no other question (but, see, Matter of Barton Realty Corp. v. Mangan, 25 A D 2d 730). Petition dismissed, without costs. Stay vacated. Gibson, P. J., Herlihy, Reynolds, Staley, Jr., and Gabrielli, JJ., concur.
