The cause below, was tried by a jury, who found a verdict for the plaintiff of $28 38: After entering the verdict, the justice made no entry of judgment; but concludes his record as follows: — The plaintiff swore out execution.

The not rendering judgment was assigned for error; on which, the Court declared the proceedings void, and ordered them set aside.
