JUDGMENT

Lee Cotirell Roy, Appellant Appeal from the 124th District Court of Gregg County, Texas (Tr. Ct. No. 49451- No. 06-25-00042-CR v. B). Panel consists of Chief Justice Stevens and Justices van Cleef and Rambin. The State of Texas, Appellee Memorandum Opinion delivered by Justice van Cleef.

As stated in the Court’s opinion of this date, we find reversible error in the judgment of the court below. Therefore, we reverse the judgment of conviction and render a judgment of acquittal. We note that the appellant, Lee Cotirell Roy, has adequately indicated his inability to pay costs of appeal. Therefore, we waive payment of costs.
