Judgment and order reversed and new trial granted, with costs to appellant to abide event. Held, that the objection to the hypothetical question put [1000]*1000to the witness Witmer was improperly overruled and the exception to such ruling was well taken. All concurred, except Foote and Merrell, JJ., who dissented.
