Laukaitis v. Bensalem Police Department

39 Pa. D. & C.3d 211, 1985 Pa. Dist. & Cnty. Dec. LEXIS 163
Pennsylvania Court of Common Pleas, Bucks County·Decided September 20, 1985·No. no. 84-008501·Published

Opinion

BIEHN, J.,

Plaintiff initiated this action to recover damages for emotional distress and for violation of his constitutional rights resulting from the confiscation of his eyeglasses by police. All of the numerous above-named defendants have filed either a motion for judgrnent on the pleadings or a motion for summary judgment arguing that plaintiff has not stated a valid constitutional claim and seeking to be released on the basis of their immunity under the Political Subdivision Tort Claims Act, 42 Pa.C.S. §8541 et seq. After a thorough review of the record, we agree and grant both motions.

In his complaint, plaintiff states that he was arrested in December, 1982 and incarcerated at Bucks County Prison. He alleges that on a daily basis he demanded the return of his eyeglasses but that such were not returned to him until April 13, [212]*2121983.
