Opinion

Order, in so far as appealed from, reversed on the law, with ten dollars costs and disbursements, and motion granted, with ten dollars costs. The plaintiff was entitled to a return by the referee of the moneys paid by it upon the first sale. Lazansky, P. J., Young, Carswell, Scudder and Tompkins, JJ., concur.
