Upon remand to this court by the Supreme Court of Alabama it is considered that this cause should be affirmed in accordance with the opinions rendered by the Supreme Court on March 27,1981, Ala., 413 So.2d 1146 and April 2, 1982, Ala., 413 So.2d 1153, in the above cause.

AFFIRMED.
