Opinion

Order denying defendant’s motion to dismiss the complaint pursuant to subdivision 7 of rule 107 of the Rules of Civil Practice, affirmed, but without costs, inasmuch as the respondent did not appear or submit a brief on this appeal. Defendant may answer within ten days from the entry of the order herein. No opinion. Lazansky, P. J., Young, Hagarty, Tompkins and Davis, JJ., concur.
