ROTHENBERG, Judge.

The defendant, Robert D. Kordish, appeals the trial court’s order denying his Motion for Return of Property. As the motion was untimely filed, see § 705.105(1), Fla. Stat. (2001), we affirm the trial court’s order denying the motion, but do so without prejudice to allow the defendant to seek any remedies available in the civil division where the forfeiture action was filed.

Affirmed without prejudice.
