delivered the opinion of the court.
The subject matter of controversy in the suit between these parties is certain real estate in the city of St. Louis, to which the [435] plaintiff below claimed title as purchaser at a sale made by the assignees of Cochran & Pollack, and also by deed from Cochran himself.
