Order Granting Plaintiffs Motion to Dismiss
On October 20, 2011 the Court held a hearing on Defendant’s Motion to Dismiss. At that hearing Plaintiff moved to dismiss the case pursuant to LTBBRCP XVI(a). No cross-claims or counter-claims have been filed in this case and no discovery has been conducted. Therefore the Court orders that this action be dismissed without prejudice.
