Opinion

In an action to recover damages for the death of plaintiff’s intestate, who sustained a fracture of the cervical vertebra as the result of diving into the shallow end of a bathing pool, judgment in favor of the defendant, dismissing the complaint at the close of plaintiff’s case, unanimously affirmed, with costs. No opinion. Present — Hagarty, Davis, Johnston, Taylor and Close, JJ.
