Writ denied. No error of law.

TATE, J., is of the opinion that a genuine issue of fact exists, necessitating a weighing of factors in the light of a full trial, and therefore feels that summary judgment was not appropriate.

CALOGERO and DENNIS, JJ., are of the opinion writ should be granted.
