Opinion

PER CURIAM.

After argument and further study of the record and authorities cited it now appears there is no conflict, hence we have no jurisdiction. In fact the distinguishing facts in this case reveal the correctness of the judgment of the District Court of Appeal, [298]*298200 So.2d 826. Therefore, the writ should be discharged.

So ordered.

CALDWELL, C. J., ERVIN and ADAMS (Retired), JJ., and WALKER and POPPER, Circuit Judges, concur. ROBERTS and DREW, JJ., dissent.
