Opinion

Rombauer, P. J.,

delivered the opinion of the court.

This is an action for the conversion of a wagcn, horses and harness, the property of the plaintiff, by the defendant to its own use. The suit was instituted before a justice of the peace, and the plaintiff recovered judgment for the full amount claimed, both before the [464]*464justice and upon trial anew in the circuit court, where the cause was tried by the court without the intervention of a jury.

This is one of three cases referred to in our opinion filed in cause number 4451. There is no evidence whatever embodied in this transcript, but we are referred for it to the evidence in cases numbers 77,974 and 77,773, of. the circuit court,,being as we infer cases numbers 4451 and 4453
