THE rule made in this cause at the last term, was now, on the motion of Mr. Botts, discharged, and The Chancellor said, that a plea to the jurisdiction of this Court, of the suit depending in the Court below, was proper ; and, thereupon the plea was filed, and referred to a Commissioner of the Court to report upon the facts.
