Opinion

The condition of the obligation was to pay 10s. weekly, secundum ordinemfactum per justiciar., etc., for keeping a bastard. The defendant on oyer pleaded nulum talem ordinem fecere. The plaintiff had judgment. It would have been otherwise if it had been secundum ordinem faciendum. Dyer, 196; Noy, 79.
