1 N.C. 124

Opinion

THE condition of the obligation was to pay 10s. weekly, secundum ordinem factum per justiciar. &c. for keeping a bastard. The defendant on oyer pleaded nullum talem ordinem fecere. The plaintiff had judgment. It would have been otherwise if it had been secundum ordinem faciendum. Dyer 196. Noy 79.
