Per Curiam.

The court did not err in overruling tlie demurrer to the petition.

Judgment affirmed.

All the Justices concur, except Gilbert cmd Bell, JJ., who dissent. Braclcett & Brennan, for plaintiff in error. Augustine Sims, contra.
