Judgment reversed and new trial granted, costs to abide the "event, on the ground that on this record the questions as to defendant’s negligence and decedent’s freedom from- contributory negligence should have been submitted to the jury. Jenks, P., J., Burr, Thomas, Carr and Woodward, JJ., concurred.
