BOWEN, Judge.

In accordance with the decision of the Alabama Supreme Court in Ex parte Jackson, 564 So.2d 891 (Ala.1990), the judgment of the circuit court is reversed and this cause is remanded for further proceedings.

REVERSED AND REMANDED.
