Opinion

Appeals (1) from a judgment of the Supreme Court (Bradley, J.), entered June 2, 2003 in Ulster County, which dismissed petitioner’s application, in a proceeding pursuant to CELR article 78, to review a determination of the Commissioner of Correctional Services finding petitioner guilty of violating a prison disciplinary rule, and (2) from an order of said court, entered September 18, 2003 in Ulster County, which denied petitioner’s motion for reargument.

Eetitioner was charged with violating the prison disciplinary rule prohibiting inmates from using controlled substances after a sample of his urine tested positive for the presence of cannabinoids. He was found guilty of that charge following a tier [1017]*1017III disciplinary hearing. After that determination was upheld on administrative appeal, petitioner commenced this CPLR article 78 proceeding challenging it. Supreme Court rejected petitioner’s procedural claims and dismissed the petition. The court subsequently denied his motion for reargument. These appeals ensued.
