Concur: Chief Judge Desmond and Judges Dye, Fuld, Van Voorhis, Scileppi and Bergan. Judge Burke dissents and votes to modify the judgment entered after the order of the Appellate Division and to reinstate the order and judgment of Special Term with the exception of the disallowance of the credit of the frozen yen fees and, as so modified, to affirm.
