This case is identical with the case of J.B. Colt Co. v.J.A. Finley,
The judgment of this Court is that the judgment of the Circuit Court be reversed, and that the case be remanded to that Court for the purpose of entering up judgment in favor of the plaintiff under Rule 27.
MR. JUSTICE FRASER concurs.
MR. JUSTICE MARION concurs in result.
MR. CHIEF JUSTICE GARY did not participate.
MR. JUSTICE COTHRAN: I concur in the result, not upon the ground that this case is analogous to or controlled by the case of Colt v. Finley, for I do not think that it is, but upon the ground that the defendant has not established his right to rescission by returning or offering to return the machine within a reasonable time after discovery of the alleged fraudulent misrepresentations.
