10 11 Pending before the Court is Defendant Meta Platform, Inc.’s Motion to Dismiss. ECF No. 12 31. Plaintiff Isa Bako failed to file an opposition in compliance with Civil Local Rule 7. The 13 Court possesses the inherent power to dismiss an action sua sponte if a plaintiff fails to prosecute 14 their action or fails to comply with court orders. Fed. R. Civ. P. 41(b); see Link v. Wabash R.R. 15 Co., 370 U.S. 626, 629-30 (1962) (dismissal for failure to prosecute); Yourish v. Cal. Amplifier, 16 191 F.3d 983, 987 (9th Cir. 1999) (dismissal for failure to comply with court orders). Accordingly, the Court hereby VACATES the May 21, 2026 noticed hearing date and ORDERS 17 Plaintiff to show cause why this case should not be dismissed for failure to prosecute and failure to 18 comply with court deadlines. Plaintiff shall file a declaration by May 20, 2026 and simultaneously 19 file either an opposition in compliance with Civil Local Rule 7-3(a) or a statement of 20 nonopposition in compliance with Local Rule 7-3(b). If Plaintiff files an opposition, Defendant 21 may file any reply by May 27, 2026, or within seven days of the date Plaintiff’s opposition is 22 docketed in ECF, whichever is later. 23 Notice is hereby provided that failure to file a written response will be deemed an 24 admission that you do not intend to prosecute, and this case will likely be dismissed. Thus, it is 25 imperative the Court receive a written response by the deadline above. 26 The Court encourages Plaintiff to seek assistance from the Federal Pro Bono Project, a free 27 service offered by the Justice & Diversity Center of the Bar Association of San Francisco.
