MILLER, Judge.

Appellant Forrest W. Derouen neither appeared nor filed a brief prior to the October 31, 1972 call of this case for argument. The appeal is considered abandoned and dismissed pursuant to LSA-C.C.P. Art. 2162; Rule VII, Section 5(b), Uniform Rules, Court of Appeal, Vol. 8 LSA-R.S., page 392; American Laminating Mfg. Co., Inc. v. Attaway, 233 So.2d 583 (La.App. 3 Cir. 1970).

Costs of this appeal are assessed to defendant appellant.

Appeal dismissed.
