Opinion

Judgment of the County Court of Nassau county reversed on the law and a new trial ordered, costs to appellant to abide the event. In our opinion, the trial court committed prejudicial error in refusing to charge the jury as requested by the appellant at folios 376-381 and 384— 388. Young, Scudder and Tompkins, JJ., concur; Lazansky, P. J., and Carswell, J., concur in result.
