In the Matter of the Marriage of Juan Carlos Castaneda, Jr. and Taylor Marie Fishburn and In the Interest of E.C. and R.C., Children
On appeal from the
249th District Court of Johnson County, Texas Judge Tiffany Strother, presiding Trial Court Cause No. DC-D202600296
JUSTICE SMITH delivered the opinion of the Court.
MEMORANDUM OPINION
Juan Carlos Castaneda, Jr. filed an appeal of a final decree of divorce which was filed in this Court on July 8, 2026. By letter from the Clerk of the Court on that same date, Appellant was notified that the filing fee of $205.00 was due and a docketing statement was required to be filed with this Court on or before Monday, July 20, 2026. The filing fee was not paid and the docketing statement was not filed by that date.
By letter from the Clerk of this Court on July 23, 2026, Appellant was notified that the filing fee was past due and that the appeal would be dismissed if the filing fee was not paid on or before August 3, 2026. By additional letter from the Clerk of this Court on July 23, 2026, Appellant was notified that the docketing statement had not been received and if one was not filed on or before August 3, 2026, the appeal would be dismissed without further notice. A letter from the Clerk was sent again on August 6, 2026 advising Appellant that the filing fee had not been paid and another letter was sent the same day advising that the docketing statement had not been received and that both were due on or before Monday, August 17, 2026, or the appeal would be dismissed.
The filing fee has not been paid and the docketing statement has not been filed. Accordingly, this appeal is dismissed for want of prosecution and the failure to follow directives from the Clerk of this Court. See TEX. R. APP. P. 42.3(b), (c).
