MEMORANDUM OPINION

Before Chief Justice Burns, Justice Molberg, and Justice Pedersen, III Opinion by Justice Molberg Before the Court is appellant’s motion to dismiss the appeal. Appellant

informs the Court that the trial court granted his motion for new trial and that he no

longer wishes to proceed with his appeal. Accordingly, we grant appellant’s motion

and dismiss this appeal. See TEX. R. APP. P. 42.1(a)(1).
