Opinion

Feb Cubiam,

We are convinced that the conclusions of fact found by the auditor in the court below were justified by the evidence, and as the report was confirmed by the court they have all the force [600]*600of the verdict of a jury. We find no error in the conclusions of law contained in the report, and we sustain the court below in dismissing the exceptions. The assignments of error are dismissed.

Decree affirmed and appeal dismissed at the cost of the appellant.
