46 A.D.2d 896, 1974 N.Y. App. Div. LEXIS 3373
Appellate Division of the Supreme Court of the State of New York·Decided December 12, 1974·Published
Opinion
On the court’s own motion, the instant removal proceeding is hereby closed. By order dated October 25,1974 petitioner was designated and authorized to institute a proceeding for respondent’s removal from office. Respondent tendered his resignation from his judicial office, effective November 29,1974, and the resignation was accepted. Accordingly, a continuation of this removal proceeding would serve no constructive purpose. Gulotta, P. J., Martuseello, Latham, Shapiro and Cohalan, JJ., concur.
