All concur, except Crosby, J., who dissents and votes for reversal on the grounds stated in the dissenting memorandum in the case above cited. (The order denies an application for a rehearing.) Present — Sears, P. J., Taylor, Edgcomb, Crosby and Lewis, JJ.
