Opinion

In a proceeding to probate a will the proponent appeals from an order of the Surrogate’s Court of Westchester County insofar as said order denies his motion to strike out certain objections pursuant to rules 103 and 109 of the Rules of Civil Practice. Order insofar as appealed from affirmed, with one bill of $10 costs and disbursements to respondents filing briefs, payable out of the estate. No opinion. Nolan, P. J., Wenzel, Beldoek, Murphy and Kleinfeld, JJ., concur.
