Opinion

Goebel, J.

[212]*212ist. The' viewers having included in their report, an award of compensation and damages, without payment of which the road could not be established, under section 999 Rev. Stat, the Board of Control has jurisdiction.

2nd. The Board of Control having refused to concur in the action of the Board of County Commissioners, the giving of the bond and -the filing of the original papers in the Probate Court by the County Auditor, were unauthorized.
