Motion to dismiss appeal granted to the extent that the appeal from so much of the order of the Appellate Division as reversed and remitted the proceeding to the Surrogate’s Court is dismissed, without costs, upon the ground that that portion of the Appellate Division order does not finally determine the proceeding within the meaning of the Constitution; motion otherwise denied.
