Motion to modify the order of this court entered October 6, 1959 so as to extend the time of appellant to file and serve record and brief. Motion granted and appeal reinstated, upon condition that appellant perfect his appeal and file note of issue and file and serve his record and brief and be ready for argument at the January 1960 Term of this court. Present — Bergan, J. P., Coon, Gibson, Herlihy and Reynolds, JJ.
