Beturn of remittitur requested and, when returned, it will be amended to read as follows: Order modified, matter remitted to Special Term for entry of final judgment for the amounts of the awards for going concern assets, and for further proceedings in accordance with [774]*774the opinion heretofore rendered, such proceedings to be severed from all prior proceedings, and, as so modified, affirmed with costs.
