Order, Supreme Court, New York County, entered on January 3, 1977, unanimously affirmed on the opinion of Stecher, J., dated October 6, 1976; and the appeal from the judgment of said court entered on November 8. 1976, dismissed as academic. Respondents Pagnan and Dreyfus shall recover of appellant "one bill of $40 costs and disbursements of these appeals. Concur—Murphy, P. J., Lupiano, Evans, Capozzoli and Markewich, JJ.
