Opinion

Per Curiam.

Respondent was admitted to practice by this Court in 1976 and is retired from the practice of law.

By petition dated March 30, 2010, petitioner charged that respondent engaged in misleading and deceiving conduct prejudicial to the administration of justice reflecting adversely on his fitness to practice law in violation of the attorney disciplinary rules (see Code of Professional Responsibility DR 1-102 [a] [3], [4], [5], [7] [22 NYCRR 1200.3 (a) (3), (4), (5), (7)]).
